FCPA Enforcement in the Pharmaceutical and Medical Device Industries


The Department of Justice (DOJ) has made it clear that the pharmaceutical and medical device industries will be continued areas of focus for enforcement of the Foreign Corrupt Practices Act (FCPA). The health care industry (especially medical device manufacturing) has already been the subject of several FCPA enforcement actions. These enforcement actions can have severe consequences: beyond the cost of an investigation itself, penalties can involve fines of millions of dollars, felony convictions, imposition of government-controlled "compliance monitors," disgorgement of profits and, for individuals, prison time.
