Miller & Chevalier Adds Barry J. Pollack to White Collar and Internal Investigations Practice

Premier Lawyer Deepens Firm's Litigation Capabilities; Complements FCPA and Criminal Tax Practices

Washington, D.C., November 3, 2008 - Miller & Chevalier Chartered today announced that Barry J. Pollack has joined the firm's White Collar and Internal Investigations practice as a Member. He practiced previously in the Washington, DC office of Kelley Drye & Warren.

Pollack represents individuals and corporations in criminal investigations and trials and in other government enforcement matters, such as Securities and Exchange Commission proceedings. He also conducts corporate investigations, including those related to the Foreign Corrupt Practices Act ("FCPA"). As a former certified public accountant, a substantial focus of his practice is the litigation of complex financial matters. Pollack also has extensive jury trial experience. He was recently inducted as a Fellow in the American College of Trial Lawyers.

"Barry adds a strategic dimension to our practice with his strong background representing individuals facing criminal investigation and/or prosecution by the U.S. government," said Mark Rochon, a member in Miller & Chevalier's White Collar and Internal Investigations Practice. "In addition, his accounting background will be of great value to our clients in the FCPA and tax areas, particularly in this era of increased government regulation and international scrutiny of complex global matters."

Pollack has successfully represented clients in a number of high-profile cases. He recently obtained acquittals on all counts on behalf of a former executive of Enron Corporation in a federal criminal case, following a month-long jury trial. In addition, he led the pro bono representation of Martin Tankleff. Based on Pollack's work, the court reversed a double murder conviction and dismissed all charges. Tankleff had spent 17 years in prison as a result of his wrongful conviction. For his successful representation of Tankleff, earlier this year the New York State Association of Criminal Defense Lawyers honored Pollack with the "Gideon Champion of Justice Award."

"Barry is a sought-after litigator and a tireless champion of his clients. He has an in-depth understanding of the complexities of civil, regulatory and criminal exposures that corporations and individuals may face," said James Bensfield, head of Miller & Chevalier's White Collar and Internal Investigations Practice. "He also brings valuable experience in the area of government and legislative investigations."

Broad-based White Collar and Internal Investigations Practice

The practice has extensive experience representing clients that face the complicated challenges presented by parallel criminal and civil litigation. Firm lawyers have litigated and handled matters that involve questions of both U.S. and international criminal law. Miller & Chevalier white collar lawyers have tried hundreds of criminal cases to juries in jurisdictions around the country. The group includes lawyers with substantial government experience, as prosecutors, public defenders, and independent counsel.

The White Collar and Internal Investigations practice often operates at the intersection of international business and domestic enforcement of U.S. laws, and maintains significant experience in investigations and fact-gathering around the world. The Internal Investigations practice is particularly integrated with the firm's International Department, and they collaborate to conduct multi-disciplinary investigations under the Foreign Corrupt Practices Act and the Export Controls statutory and regulatory regimes.

"I am very pleased to be joining Miller & Chevalier and to work with such a tremendous group of talented litigators," said Pollack. "The firm has a sophisticated, top-notch white collar practice, and I look forward to working with the team to continue growing the practice and expanding its representation of individual corporate executives and public figures in financial and other criminal litigation."
