Miller & Chevalier Health Reform and Hot Topics Teleconference

11.12.08Miller & Chevalier held an invitation-only teleconference to review the health reform proposal of President-elect Obama and the plethora of new health and welfare plan rules that have been issued as the current administration prepares to leave office. For example, Congress has recently passed a greatly expanded mental health parity rule, a mandate to cover certain college students under parents' health plans, and an expanded disability law. In addition, federal agencies have recently issued final Newborns' and Mothers' Health Protection Act regulations, a request for information related to the Genetic Nondiscrimination Act of 2008, and Medicare Secondary Payer mandatory reporting requirements. During the conference call we'll provide a summary of each of these issues, as well as an update on recent guidance regarding the Massachusetts Connector and the Ninth Circuit Court of Appeals' decision that ERISA does not preempt the San Francisco employer health care mandate. (Still expected before the end of the year are final cafeteria plan and ERISA fee disclosure regulations.)
