06.01.09Barry Pollack comments on the plea by client Kevin Howard, a former Enron executive, to one count of falsifying books and records. Under the plea agreement, Mr. Howard, who faced approximately 15 years imprisonment under applicable sentencing guidelines, will instead be sentenced to between four and twelve months of probation or home confinement. "More than six years after the government charged Mr. Howard they offered a reasonable resolution to the case, which Mr. Howard readily accepted," said Pollack. "The case involved a single transaction from which Mr. Howard received no personal benefit. It made little sense to continue to pursue the matter almost a decade after that transaction occurred."
