"Taxes lurk behind court test of Obama health law"
05.16.12Garrett Fenton is quoted regarding two tax provisions that are part of the Patient Protection and Affordable Care Act (PPACA).  The healthcare law includes a 3.8-percent boost in taxes on investment income and a 0.9-percent increase in the Medicare payroll tax, both of which will affect people who earn more than $200,000 a year.  The U.S. Supreme Court is expected to rule on the constitutionality of PPACA by late June.  In doing so, the court could decide to take a hybrid approach to the tax issues, distinguishing between provisions closely linked to the individual mandate and those that are not.  "That is where the uncertainty comes into play," Fenton said.  "Which provisions are they going to invalidate? The employer penalty? Tax credits for small business?"
