"Defense Bar Gains Ground in Money Laundering Battle"
09.24.10Barry Pollack comments on two recent U.S. Court of Appeals for the Sixth Circuit decisions in which the court used a 2008 U.S. Supreme Court ruling in a drug-related criminal case and applied it in a white collar context. These decisions could assist the defense bar against prosecutors trying to pursue money laundering charges in white collar cases. “For years, legal concepts that were created to address drug transactions have been imported by prosecutors into white collar offenses.” said Pollack. “This is almost the reverse. This is an area where the Supreme Court put a little bit of a break on the use of money laundering in the drug context, and the lower court is adopting the same concept in a white collar prosecution.”
