02.19.10Marianna Dyson discusses the worker classification issue that was apparently at the core of the Austin Crash Pilot's long-standing dispute with the IRS. A 1978 law that limits the extent to which firms can be held liable for payroll taxes if the IRS insists that workers are wrongly classified was changed in 1986 to exclude software engineers, such as the pilot. Dyson says, "The 1978 law was intended to be a temporary provision. Now people have realized, it's bad policy. It encourages smaller businesses to say, if we treat them as independent contractors, what's the worst that can happen?"
