"Ex-Banker Arbizu Says He Won't Respond to JPMorgan"
12.31.09Barry Pollack discusses the potential settlement between the Financial Industry Regulatory Authority (FINRA), a financial-industry watchdog group and Hernan Arbizu, a former JPMorgan banker accused of embezzlement. Under the agreement, FINRA would settle its investigation into his activities if he agrees to be banned from the securities industry. "FINRA has no criminal enforcement authority and can't dictate to criminal authorities to drop a case," said Pollack. "That said, the criminal authorities could certainly take into account whether he has settled the matter to FINRA's satisfaction in making their own decision whether or not to pursue the case criminally."
