11.26.09Barry Pollack discusses how R. Allen Stanford’s situation is different than many executives facing allegations of corporate fraud, in that he was deemed a flight risk and has been behind bars since June as well as having his assets frozen, leaving no money to pay for his defense. “Each of the differences for Stanford presents its own challenges,” said Pollack, who handled several Enron defenses. Pollack said the SEC suing months before the Justice Department charged Stanford in a criminal case showed unusual aggression and might have been a response to criticism that the SEC had been too slow to recognize the massive fraud by Bernard Madoff.
