11.12.09Barry Pollack comments after New York State Supreme Court Justice John Cataldo dismissed the indictment against Fernando Bermudez, who has served 18 years in prison after being wrongly convicted of a 1991 shooting. Pollack, who led Bermudez's pro bono defense team, asked the judge to recommend that the federal sentence be vacated, and Cataldo agreed, saying that the “defendant has demonstrated his actual innocence.” "At this point Fernando doesn't owe the system time - they owe him," Pollack said outside court.
