09.29.09Marianna Dyson comments on South Carolina Governor Mark Sanford's use of state planes for personal and political trips that were not properly treated as taxable fringe benefits, opening up both Sanford and his employer, the state of South Carolina, to the possible imposition of federal tax penalties. "The state appears to take the position that they assume that all of these are business flights," said Dyson, a former IRS fringe benefits lawyer and one of the nation's leading experts on the topic. By doing that, the state "ignored the rules applicable to the use of an employer's aircraft."
