06.20.16Barry Pollack was quoted regarding former Secretary of State Hillary Clinton's use of a private email server as it relates to the possibility of charges under the Espionage Act. Clinton's use of the server may mark the first time the Espionage Act could have been violated exclusively through technology that was not in existence when the law was created. "The Espionage Act has been used to bring prosecutions that are well beyond what was envisioned when the statute was passed," Pollack said. "It was passed in World War I to prevent espionage on behalf of foreign powers. That is a far cry from someone in leaking classified information to the New York Times." He added, "I do not believe the Department of Justice should be using the Espionage Act to pursue such cases."
