02.23.16Barry Pollack was quoted regarding former Central Intelligence Agency (CIA) agent Jeffrey Sterling's Fourth Circuit appeal of a conviction for leaking classified information to The New York Times. The appeal argues the case was built on circumstantial evidence and legal flaws. The legal arguments raised on appeal were born from the government's weak, circumstantial case at trial, said Pollack, who represented Sterling at trial. "We don't think the evidence was adequate to convict, but obviously the jury found otherwise," he said. "But the legal errors are not mere technicalities. [The failure of the government adequately to establish venue] is a fundamental legal issue that derives from the inadequacy of the government's evidence."
