11.17.15James Tillen was quoted regarding Assistant Attorney General Leslie Caldwell's recent announcement that the U.S. Department of Justice (DOJ) is looking to hire 10 prosecutors to its Foreign Corrupt Practices Act (FCPA) unit. Some practitioners speculate the DOJ will use the new hires to prosecute individuals charged in foreign bribery schemes. However, if more individuals are charged, the agency will need to improve its track record with respect to trials. "They haven't done well in trials," Tillen said, pointing to the agency's midtrial settlement with the former CEO of PetroTiger Ltd. The former CEO, who originally faced up to 20 years in prison had he been convicted on the original charges, was granted a noncustodial sentence in exchange for pleading guilty to some FCPA violations. "Devoting more resources could help with that trial work," Tillen said.
