06.26.15Erin Sweeney commented on health insurance issues that will require the prompt attention of companies and general counsel in light of the Supreme Court's recent King v. Burwell decision, which keeps the provisions of the Affordable Care Act in place. Sweeney said companies should figure out their exposure to the "Cadillac" tax, set to take effect in 2018. Companies should look into options to avoid the tax altogether, she said, noting that there are private marketplace options that provide healthcare offerings. Sweeney added that general counsel should also try to determine if any employee hours were reduced or an employee was terminated just before the employee became eligible for coverage as a way to avoid providing health insurance. If so, the company could be at risk for litigation, she said.
