Barry Pollack Quoted in New York Law Journal on New Hearing in Bermudez Case

08.10.09Barry Pollack comments on the granting of a new hearing in the case of Fernando Bermudez, who has been imprisoned for 17 years for a murder in which all eyewitnesses have recanted and no scientific or DNA evidence exists to implicate the defendant. "I think it is a great step forward," said Pollack, lead counsel representing Mr. Bermudez. "The judge's decision recognizes the substantial evidence before the court that Mr. Bermudez is innocent of the crime and had nothing to do with it." Pollack said that based on the Sept. 1 hearing, Justice Cataldo could order a new trial for Mr. Bermudez or vacate the conviction.
