10.24.14Matthew Reinhard was quoted regarding multijurisdictional cooperation in internal corporate investigations. His comments were made at the International Bar Association's Annual Conference in Tokyo. During a panel discussion titled "Levelling the playing field -- defending multinational companies in a world of increased cross-border cooperation," Reinhard said that because enforcement agencies in the United States "wield the biggest stick" in terms of potential criminal penalties, companies are often best advised to focus their attention on getting their house in order there first. U.S. authorities typically demand a thorough internal investigation by outside counsel, the results of which help determine whether enforcement action is necessary and what, if any, penalty will be issued.
