11.08.13Marianna Dyson is quoted regarding U.S. v. Quality Stores, which will be heard by the Supreme Court in January regarding whether payroll taxes are owed on severance payments to laid-off workers. With more than 2,400 claims filed requesting total refunds exceeding $1 billion, the Court's justices may take into account the potential for huge revenue loss. According to Dyson, one claim filed by a firm can cover hundreds or even thousands of former employees, and some are more than a decade old. With respect to the justices' ruling, a tie vote is possible, as Justice Elena Kagan has recused herself from the case, Dyson said, adding that if there is a tie, the decision would be affirmed for the Sixth Circuit (Tennessee, Kentucky, Ohio and Michigan) and the court might take up the issue again in another case.
